Terms of Use
These Platform/website/game and Services are provided by FunLearnWorld Tech Co., Ltd, having its registered office Room D3129, Floor 3, Building 1 (North), No.368 Liuhe Road, Binjiang District, Hangzhou, Zhejiang Province, China. (hereafter referred to as “FunLearnWorld”, “FunChinaWorld”, “we”, “us”, and “our”). Please read these terms of use carefully before using the Platform and Services.
The Terms is a legal agreement between you, together with FunLearnWorld. Clicking the checkbox that states you agree to the Terms of Use (hereafter, “ToU”), and you acknowledge that you have read, understood, and consent to be bound by these terms, which may be updated from time to time without notice to you. If you do not unconditionally agree to all the conditions outlined in the ToU, you may have no right to access or use the Platform.
When using the Platform and Services, you will also be subject to the FunChinaWorld Privacy Policy and any posted guidelines, policies or rules applicable to specific features of the Platform.
Notwithstanding the preceding, nothing in this Terms supersedes or limits your rights under (1) the terms and conditions of any written agreements you have entered into with FunChinaWorld regarding the use of the Platform, or (2) applicable laws or regulations to the extent these terms are prohibited by such laws or regulations. In the event of any conflicts between the ToU and the terms and conditions of an applicable written agreement, you have entered into with FunChinaWorld, the terms and conditions of the written agreement shall control.
IMPORTANT: if you are under the age of 13, you must have your parent’s or guardian’s consent to comply with the Terms and the ToU.
In the course of using the Platform, you and other users may provide or post specific content or information which may be used by FunChinaWorld. Please visit our Privacy Policy for additional information on the types of information different types of users can provide.
You retain all ownership rights to your information. FunChinaWorld does not claim any ownership rights over your personal information. FunChinaWorld will only share and use your personally identifiable information in accordance with FunChinaWorld's current Privacy Policy.
As a condition to using FunChinaWorld, you may be required to register and select a password and username or provide additional contact information (hereafter, "Registration Data").
You must provide FunChinaWorld with accurate, complete, and updated Registration Data. You may not select or use as a Company User ID or a name of another person with the intent to impersonate that person. You will not provide any false information or create an account for anyone other than yourself without permission.
FunChinaWorld reserves the right to refuse registration or cancel Registration Data in its discretion.
You shall be responsible for maintaining the confidentiality of your password and will not share with anyone or let anyone else access your account. You may not transfer your account to anyone.
The Platform is owned and operated by FunLearnWorld Tech Co., Ltd. We may change, suspend or discontinue all or any part of the Platform-based Services (hereafter, “Platform” or “Services”) at any time, may impose limits on certain features and Services, or restrict your access to parts or all of the Services without notice or liability.
You shall be responsible for obtaining and maintaining any equipment or ancillary Services needed to connect to, access, or otherwise use the Platform, including, without limitations, modems, hardware, software, projection equipment, internet access and telephone service, and shall be responsible for ensuring that such equipment or ancillary Services are compatible with the Platform.
The Content of the Platform and Services are intended solely for the educational use of Platform users and may only be used in accordance with the terms of this ToU (hereafter, “Content”). Content is protected by copyright and other intellectual property laws.
You shall abide by all copyright notices, trademark rules, information, and restrictions contained in any Content accessed through the Services, and shall not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purposes whatsoever any Content or third party submissions or other proprietary rights not owned by you (i) without the express prior written consent of the respective owners, and (ii) in any way that violates any third party rights.
The Platform is protected by copyright as a collective work and/or compilation under copyright laws and international conventions. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Terms), create derivative works based on, distribute, perform, display, or in any way exploit, any of the Content, materials, or Services in whole or in part.
You may download or copy the Content (and other items displayed on the Platform for download) for use within permission or personal home-use only, provided that you maintain all copyright and other notices contained in such Content, but shall not store any significant portion of any Content in any form. Copying or storing of any Content other than for the purposes permitted by this document is expressly prohibited without prior written permission from FunChinaWorld or the copyright holder identified in such Content's copyright notice.
You acknowledge that all Content accessed by you using the Services is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom. Under no circumstances will FunChinaWorld be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred in connection with use of or exposure to any Content posted, emailed, accessed, transmitted, or otherwise made available via the Services.
You acknowledge and agree that any Content which is inputted by you into the Platform (hereafter, “Input”), shall belong to FunChinaWorld without any obligation of FunChinaWorld to pay compensation of any kind to you. You hereby assign and agree to assign to FunChinaWorld all rights and interest in and to the Input, and waive and agree not to exercise any moral rightsconcerning the Input.
Access to the basic version of FunChinaWorld is provided to you for free with limited time, while the premium version of FunChinaWorld requires a paid membership. By starting your FunChinaWorld membership, you expressly agree that we are authorized to charge you the membership fee associated with membership (monthly, quarterly, annual, or lifetime). The prices associated with each membership and other charges are subject to change without notice. Membership begins on the date it is purchased (the "Purchase Date") and will continue until canceled. Membership shall not be transferred or assigned to any other third-party nor shall a third-party be granted access to the Platform through use of your Registration Data.
We will bill the fee associated with your Membership at the then-current rate plus applicable taxes. To avoid billing of the next membership fee, you must cancel your membership before it renews.
You could cancel the subscription any time by contacting us at service@funchinaworld.com, and it will take at least one week to complete, and you will get the refund for the period which you have not used.
FunChinaWorld, in its sole discretion, reserves the right to terminate your account or any part thereof without warning or notice, if you fail to comply with the terms outlined in the ToU, which may result in the forfeiture and destruction of all information associated with your membership. FunChinaWorld may suspend or terminate your access to the Platform at any time for any reason without restricting and notice. You agree that FunChinaWorld shall not be liable to you or any third parties in the event of such termination of access to the Platform.
Your privacy is extremely significant to us, and we take great care to limit what we collect and how we use it and to enable you to understand our policies. For information regarding FunChinaWorld’s treatment of personally identifiable information and other user data, please review the Privacy Policy, which is hereby incorporated into this Terms by reference.
The Platform may contain links to third-party websites that are not owned or controlled by FunChinaWorld. When you access third-party websites, you do so at your own risk. FunChinaWorld encourages you to be aware when you leave the Platform and to read the terms and conditions and privacy policy of each third-party website that you visit.
FunChinaWorld has no control over and assumes no responsibility for, the Content, accuracy, privacy policies, or practices of or opinions expressed in any third-party websites. Besides, FunChinaWorld will not and cannot monitor, verify, censor or edit the Content of any third-party websites.
By using the service, you expressly relieve and hold harmless FunChinaWorld from any liability arising from your use of any third-party website. Your interactions with organizations and/or individuals found on or through the Services, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that FunChinaWorld shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.
If there is a dispute between participants on this site, or between users and any third party, you understand and agree that FunChinaWorld is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release FunChinaWorld, its officers, employees, agents, and successors in rights from claims, demands, and damages (actual and consequential) of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our service.
The Platform or Services are provided "as is", and without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, and compatibility. No warranty is made that the service will be error-free, that errors will be corrected, that the Platform or Services will be uninterrupted or secure, that the Platform or Services will meet your expectations, or that the Platform or the servers that make such Content available shall be free of viruses or other harmful components. Any material obtained through the use of the Platform or Services is done so at your discretion and risk, and FunChinaWorld shall not be responsible for any damage or loss of data that results from obtaining such material. No warranty is made regarding the use or results of use of the Platform, Services, or any portion thereof. Any advice or information, whether oral or written, obtained by you from FunChinaWorld shall not create any warranty not expressly stated in the ToU.
FunChinaWorld has no special relationship with or fiduciary duty to you. You acknowledge that FunChinaWorld has no control over, and no duty to take any action regarding: which users gain access to the Platform; what Content you access via the Platform; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content.
FunChinaWorld has provided the Platform and Services "as is" and shall not be liable for any direct, indirect, incidental, special or consequential damages including but not limited to lost profits, personal injury, property damage, loss of data or other intangible losses, even if we have been advised of the possibility of such damages, resulting from (A) the use of or inability to use the service; (B) the conduct or actions, whether online or offline, of any user of the Platform; (C) unauthorized access to or alteration of your transmissions or data; or (D) any other matter relating to the Platform. In no event shall our total liability to you for all damages, losses, or any other claims related to the Platform whether in contract, tort or otherwise exceed the amount paid by you, if any, or $100, whichever is less.
You are responsible for all of your activity in connection with the Platform. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your right to access or use the Platform.
You may not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any FunChinaWorld user.
Use of the Platform to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material (including material that may be considered threatening or obscene), or engage in any kind of illegal activity is expressly prohibited.
You will not run Mailing list, Listserv, any form of auto-responder, or "spam" on the Services, or any processes that run or are activated while you are not logged on to the Platform, or that otherwise interfere with the proper working of or place an unreasonable load on the Platform infrastructure. Further, the use of manual or automated software, devices, or other processes to "crawl" or "spider" any page of the Platform is strictly prohibited.
The Platform and Services are for your personal use only. You may not use our Platform and Services for commercial use. You agree not to copy, reproduce, reverse-engineer, create derivative works, disassemble, adapt, or exploit in any other way the Platform, Services, or any portion thereof. The Platform and Services are owned entirely by FunLearnWorld Tech Co., Ltd and no right or title is transferred to you.
You may not transfer your account to anyone without express prior written consent of FunChinaWorld.
The Terms of Use shall be governed under the laws of the People’s Republic of China and you agree to submit to the jurisdiction of the Courts of Zhejiang Province of China in respect of any matter relating to the Terms of Use.
